By visiting or using the website at escondidomasonry.com (the "Site"), or by requesting or receiving services from ESC Escondido Masonry ("we," "us," or "our"), you agree to these Terms and Conditions. If you do not agree, please do not use the Site or engage our services.
ESC Escondido Masonry provides residential and commercial masonry contractor services in Escondido, CA and surrounding areas. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, and related masonry work.
All services are subject to a written scope of work agreed upon by both parties before work begins. We reserve the right to decline any project at our discretion.
All estimates are provided in writing and are based on information available at the time of the site visit. Estimates are valid for 30 days from the date issued unless otherwise stated.
An estimate is not a fixed-price contract. If unforeseen conditions are discovered during the course of work - such as hidden structural damage, unexpected soil conditions, or concealed utility conflicts - we will notify you before proceeding with any work that would increase the cost. No additional charges will be added without your prior written or verbal approval.
Prices are subject to change for projects that are delayed more than 60 days from the estimate date due to material cost changes or other factors outside our control.
Project start dates are scheduled after a signed agreement and deposit are received. We will make reasonable efforts to start and complete work on the agreed schedule. Delays caused by weather, material availability, permit processing, or other factors outside our control are not grounds for penalty or breach of contract.
You may cancel a scheduled project by providing written notice at least 5 business days before the planned start date. If work has not yet begun, any deposit paid will be refunded minus any costs already incurred for permits, materials ordered, or preparation work performed.
If you cancel with less than 5 business days notice, or if the project is stopped by you after work has begun, costs already incurred plus a reasonable portion of the contract price reflecting work completed will be due and payable.
Payment terms are specified in each individual project agreement. In general, projects require a deposit at the time of scheduling, progress payments as work proceeds on larger jobs, and a final payment upon completion.
Final payment is due upon completion of the work and before the project is considered closed. Accepted payment methods will be specified in your project agreement.
Balances not paid within 30 days of the due date may be subject to a late fee and, if necessary, collection proceedings. You agree to pay reasonable collection costs, including attorney fees, in the event collection action becomes necessary.

Where required by local law, we will obtain the necessary building permits before commencing structural work. Permit fees are either included in the project estimate or billed separately - this will be stated in your written agreement.
You agree not to request that we perform work without required permits. Unpermitted structural work can create legal and financial complications for you as a property owner, and we will not participate in arrangements that circumvent permit requirements.
We provide a written warranty on workmanship for each completed project. Warranty terms, including duration and coverage, are specified in your project agreement and warranty document.
Warranties cover defects in workmanship under normal use and conditions. They do not cover damage caused by acts of nature, subsequent work by others, misuse, neglect, or conditions that were pre-existing and outside the scope of the work performed.
Manufacturer warranties on materials, where applicable, are passed through to you and are subject to the terms set by the manufacturer.
To the fullest extent permitted by law, ESC Escondido Masonry's total liability to you for any claim arising out of or related to our services or the Site - whether in contract, tort, or otherwise - is limited to the amount you paid us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages of any kind, including lost profits, loss of use, or damage to property not directly caused by our work, even if we were advised of the possibility of such damages.
The content on this Site is provided for general informational purposes. We make no warranties, express or implied, about the accuracy, completeness, or suitability of the information on the Site for any particular purpose. Nothing on the Site constitutes professional advice specific to your property or situation.
If a dispute arises from or relates to our services or these Terms, we encourage you to contact us first to resolve it directly. Most disputes can be resolved by talking through the concern in good faith.
If direct resolution is not possible, both parties agree to attempt mediation before pursuing any other legal remedy. If mediation does not resolve the dispute, it may be submitted to binding arbitration under the rules of the American Arbitration Association, or to the appropriate court in CA.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration will be brought in the state or federal courts located in San Diego County, California, and you consent to jurisdiction there.
We may update these Terms and Conditions from time to time. Changes take effect when posted on the Site with an updated effective date. Your continued use of the Site or engagement of our services after changes are posted constitutes acceptance of the updated terms. We recommend reviewing this page periodically.
